Waiver of Liability, Terms and Conditions
TUMBLIN4KIDS,LLC dba Edington Family Fitness (EFF) Waiver of Liability and Release
I hereby release and forever discharge Tumblin4Kids, LLC/DBA EFF coaches, subcontractors, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, assigns, affiliates, Shellie Edington and all employees of any and all liability whatso-ever associated with instruction from Tumblin4Kids, LLC dba Edington Family Fitness. I am fully aware that with any physical movement, exercise, lifting of weights or activity there is inherent risk of physical injury, psychological injury, illness, catastrophic injury, paralysis, death, any damages, economical or emotional loss, that I may suffer as a direct result of my or my child(ren)’s participa-tion with EFF is released and forever discharged. And as consideration for the right to participate in online fitness classes performed by EFF I shall be aware and make my child(ren) aware of the possibility of injury and to follow all safety rules and the coach’s instructions. My child(ren) and I are cleared by our physicians to participate in exercise.
I am fully aware that am using my own equipment and space and that there is inherent risk of physical injury, psychological injury, illness, catastrophic injury, paralysis, death, any damages, economical or emotional loss, that I or my family may suffer as a direct result of using my/our per-sonal equipment or space while participating with EFF is released and forever discharged.
I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any all rights, claims or causes of action of any kind whatsoever arising out of my or my child(ren)’s par-ticipation with Edington Family Fitness. This waiver is broad and inclusive as permitted by law of the state of Ohio and with my signature I waive my right to sue. If any portion is found invalid, it is agreed that the balance shall continue in full legal force and effect. I have read the above waiver of liability and release. I sign this release as my own free act. I understand that this is a legally binding agreement.

Welcome to Edington Family Fitness (“EFF,” “we,” “us,” or “our”), operated by Tumblin4Kids, LLC dba Edington Family Fitness. By accessing our website (edingtonfamilyfitness.com), booking services, purchasing a membership or package, or using our facilities (including the outdoor sauna and cold plunge), you agree to these Terms and Conditions.
1. Acceptance of Terms
By using our services or facilities, you confirm that you have read, understood, and agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.
2. Services
We offer in-person personal training, group classes, online/virtual programming, and limited recovery amenities (including sauna and cold plunge) at our Granville, Ohio location. Services are available to clients who meet our eligibility requirements and complete required paperwork (including the Waiver of Liability).
3. Sauna + Plunge Package (Limited Membership)
• Price: $150 per month for up to two (2) 30-minute sauna + cold plunge sessions per week.
• Eligibility: Available only to current in-person training clients.
• Availability: Limited to a maximum of five (5) subscribers at any time.
• Complimentary sessions: This package is in addition to any complimentary sauna access included with regular training sessions.
• Capacity: The outdoor sauna comfortably accommodates up to six people. Each person must be registered and secure their own spot.
• Booking: Sessions must be scheduled in advance through our booking system. Walk-ins are not guaranteed.
• Conduct: Remain clothed. Bring a water bottle and two towels. Rinse before and after cold plunge as instructed. Follow all posted safety guidelines and staff directions.
• Health: Sauna and cold plunge involve heat and cold stress. You are responsible for consulting your physician if you have any medical conditions. Participation is at your own risk.
4. Payments and Billing
• Payments are processed securely through our payment provider.
• Memberships and packages are billed according to the schedule selected at purchase.
• All sales are final unless otherwise stated in writing.
• Failure to pay may result in suspension or cancellation of access.
5. Cancellation and No-Show Policy
• Sauna + Plunge Package: Monthly memberships may be canceled with at least 7 days’ written notice before the next billing date. Unused sessions do not roll over or receive refunds.
• Training sessions: Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may be charged the full session fee or forfeit the session.
• We reserve the right to cancel or reschedule sessions due to weather, maintenance, or unforeseen circumstances.
6. Assumption of Risk and Liability
Participation in physical activity, sauna, and cold plunge involves inherent risks of injury, illness, or other harm. By using our services and facilities, you acknowledge these risks and agree to the terms of our Waiver of Liability and Release, which is incorporated by reference into these Terms. To the fullest extent permitted by Ohio law, Edington Family Fitness, Tumblin4Kids, LLC, Shellie Edington, and their agents, employees, and representatives are not liable for any injury, loss, or damage arising from your participation.
7. Code of Conduct
Clients and guests must treat staff, other clients, and the facility with respect. We reserve the right to refuse service or terminate a membership for disruptive, unsafe, or inappropriate behavior.
8. Privacy
Your use of our website and services is also governed by our Privacy Policy, available at https://www.edingtonfamilyfitness.com/privacy-policy.
9. Changes to Terms
We may update these Terms and Conditions at any time. Continued use of our services after changes constitutes acceptance of the revised terms. The current version will always be posted on our website.
10. Governing Law
These Terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Licking County, Ohio.
